Terms of Use & Subscription Agreement

These Terms (“Terms”) govern your access to and use of RealStock (“RealStock”, “we”, “us”, “our”), a digital stock library and AI image generation service. By accessing or using RealStock, you agree to these Terms. If you do not agree, do not use the service.

1. Who We Are

RealStock is operated by Qwe Co., Ltd. (Japan). Services, billing, and operations are provided from Japan. The service is designed primarily for English-language users.

2. Supported Countries / Availability

RealStock is intended for customers in the following supported countries/regions: United States, Canada, Australia, New Zealand, Singapore, Japan, and Hong Kong.

We may restrict, block, or refuse access, purchases, or subscriptions from other countries/regions to reduce compliance, tax, and dispute risks. Availability is not guaranteed in all locations.

3. Service Overview

RealStock provides AI-generated images and related assets featuring the fictional AI model “Elis”. The content does not depict a real person. You are responsible for ensuring your use complies with local laws, advertising standards, and platform rules.

You may browse and preview the library without a subscription. Downloading full-quality files and receiving a commercial license requires an active paid subscription and sufficient credits.

RealStock may also provide AI-powered generation and editing features. These features may change over time, and usage may consume credits.

4. Intellectual Property

All images, metadata, descriptions, and other materials on RealStock (“Content”) are protected by copyright and other intellectual property laws. No ownership is transferred to you. You receive only a limited license under these Terms and your plan.

5. Credits (Monthly Reset)

Paid plans include a monthly allocation of “Credits” used to access downloads and AI features.

  • Credits are added monthly while your subscription is active (including annual subscriptions).
  • Credits reset monthly. Unused credits do not roll over and expire at the reset.
  • Credits have no cash value, are non-refundable, non-transferable, and cannot be resold.
  • If you do not have enough credits, you cannot complete the action (unlock / AI generation / AI edit).
  • We may adjust credit costs, allocations, or reset timing to prevent abuse and ensure fair usage.

6. License & Plan Scope

Your license scope depends on your paid plan. Seat limits may apply and may be enforced technically or contractually.

6.1 Pro Plan

  • Commercial use for one brand or one client
  • 50 credits / month (credits reset monthly)
  • Unlock (full download access): 3 credits per image
  • Once unlocked, you may export/download the unlocked image unlimited times while available on the service
  • Generated creations in your account may be exported/downloaded without additional unlock credits
  • Editing, cropping, overlay text, and composite use permitted
  • No attribution required unless stated otherwise
  • No resale, redistribution, sublicensing, template packs, or stock-site redistribution
  • No AI/ML training use
  • Account sharing is prohibited

6.2 Studio Plan

  • Commercial use for your organization
  • Internal multi-user access (team use within one company; up to 5 team members)
  • 150 credits / month (credits reset monthly)
  • Unlock (full download access): 3 credits per image
  • Once unlocked, you may export/download the unlocked image unlimited times while available on the service
  • Generated creations in your account may be exported/downloaded without additional unlock credits
  • Stealth Mode: available for generation (when enabled, creations are not publicly showcased)
  • No resale, redistribution, sublicensing, or stock-site redistribution
  • No external client delivery unless separately licensed
  • No AI/ML training use

6.3 Enterprise Plan

  • Commercial use across multiple in-house brands within one organization
  • Internal multi-user access (team use within one company; up to 20 team members)
  • 600 credits / month (credits reset monthly)
  • Unlock (full download access): 3 credits per image
  • Once unlocked, you may export/download the unlocked image unlimited times while available on the service
  • Generated creations in your account may be exported/downloaded without additional unlock credits
  • Stealth Mode: available for generation (when enabled, creations are not publicly showcased)
  • No resale, redistribution, sublicensing, or stock-site redistribution
  • No external client delivery unless separately licensed
  • No AI/ML training use

If your intended use is unclear (e.g., agency delivery, client handoff, sublicensing), you must not proceed unless your license explicitly permits it.

7. Public Showcase (Pro Plan)

Under the Pro Plan, selected user-generated creations may be showcased publicly (for example, in a public gallery or explore feed). This helps demonstrate the service and inspire other users.

  • Not all creations are showcased; selection may be random, algorithmic, or editorial.
  • Showcased items may include the image and related prompt text.
  • We apply filters and may manually review to reduce the risk of inappropriate content (e.g., excessive nudity or unsuitable violence) appearing publicly.
  • Studio and Enterprise users may use Stealth Mode to prevent public showcasing when enabled.
  • We may remove any showcased item at any time at our discretion.

8. Storage & Retention Policy

We retain generated creations for a limited time depending on your account status:

  • Active subscription (Pro / Studio / Enterprise): generated creations are retained while your subscription is active.
  • After cancellation: generated creations remain retained for up to 30 days. If you resubscribe within this period, your generated library may be restored.
  • Credit-only purchases: generated creations may be retained for up to 14 days and may be deleted afterward as part of routine cleanup.

We are not responsible for data loss beyond the retention window. You are responsible for exporting and saving content you require.

9. Prohibited Uses (All Plans)

  • Resale, redistribution, sublicensing, or sharing the Content as standalone files
  • Use in stock libraries, templates, sticker sets, print-on-demand repositories, or similar services where the Content is the main value
  • Trademark, logo, or service mark creation/registration derived from the Content
  • Pornographic, defamatory, fraudulent, unlawful, or rights-violating use
  • AI/ML training, dataset creation, model fine-tuning, or embedding Content into training pipelines (without prior written consent)
  • Implying endorsement by “Elis” or RealStock
  • Automated scraping, mass-downloading, circumvention of paywalls/credits, or abuse of the service
  • Account sharing or use beyond your plan’s permitted internal seats

Violations may result in immediate suspension or termination without refund.

10. Subscriptions, Billing, and Automatic Renewal

Paid plans are billed via Stripe and renew automatically (monthly or annually depending on your selection) unless you cancel before the next billing date. You are responsible for managing your subscription, including cancellation, through the Stripe customer portal or your account billing page (if available).

Credits are added monthly during an active subscription (including annual subscriptions) and reset monthly. Unused credits do not roll over.

11. Cancellation & Refund Policy

You may cancel at any time. Access remains available until the end of your current billing period. Due to the nature of digital content and instant access, refunds are generally not available, except where required by applicable law. Digital Content is considered delivered when access is granted.

12. Support Policy (Self-Serve)

RealStock is primarily self-serve. We do not provide:

  • Phone support
  • Guaranteed email support
  • Individual troubleshooting
  • Custom work, edits, or revisions
  • Reinstatement after termination for violations

13. Warranty Disclaimer

The Content and service are provided “as is” and “as available”, without warranties of any kind (express or implied), including fitness for a particular purpose and non-infringement.

14. Limitation of Liability

To the maximum extent permitted by law, we are not liable for loss of profits, revenue, business interruption, consequential/incidental/special/punitive damages, data loss, or third-party claims arising from your use. Our total liability is limited to the amount paid by you for the most recent billing period.

15. Termination

We may suspend or terminate access at any time for violations, illegal activity, abuse, attempted resale/redistribution, account sharing, or circumvention of credits or access controls. No refunds will be issued upon termination, except where required by law.

16. Governing Law & Jurisdiction

These Terms are governed by the laws of Japan. All disputes shall be subject to the exclusive jurisdiction of the Tokyo District Court, to the fullest extent permitted by law.

17. Changes to Terms

We may update these Terms at any time. Continued use of the service after updates constitutes acceptance of the updated Terms.

18. Contact

RealStock is operated as a self-serve service. If an in-site contact method is provided, it is the only supported channel and responses are not guaranteed. If operator information is legally required prior to purchase in a specific jurisdiction, it will be provided only to the extent required by applicable law.
